摘要
抗日边区婚姻立法,在中国婚姻立法史上虽为短暂的一瞬,但却承载着破除封建婚姻家庭制度、移风易俗、创建新民主主义婚姻家庭制度、支持抗战的作用,具有非凡的历史意义。其内蕴的自由意志,在于实现自由价值表达、自由权利选择、自由责任承担;其内蕴的道德责任,在于倡导男女平等、力主人格独立、维护民族大义。抗日边区婚姻立法通过对自由意志的表达与实践,达致对道德责任的承担与追求,进而实现自由意志与道德责任的有机统一。
Although a short moment in the marriage legislation history of China, the marriage leglstauon in me Anti-Japanese Border Area carries extraordinary historical significance in breaking away from feudal marriage and the family system, changing old customs and habits, setting up a new and democratic marriage and family system, and supporting the Anti-Japanese War. The free will involved therein aimed to realize the expression of values, the choice of the right to freedom, and the undertaking of the responsibility involved in freedom. The moral obligation contained therein was in advocating the equality of man and women, promoting an independent personality, and maintaining Chinese nationalism. By means of the expression and practice of free will, marriage legislation in Anti-Japanese Border Area was designed to undertake and pursue moral obligation, and realize the organic unity of free will and moral obligation.
