摘要
《国家教育事业发展第十二个五年规划》指出:"未来五年要重点完善民办学校章程建设、理(董)事会制度建设。"完善民办高校章程,加强制度建设,已成为民办高校应对新形势的要求。文章回顾过去30多年民办高校章程建设的历程,总结民办高校章程建设的基本特征,并以北京市15所民办高校为例,从章程内容、修订与核准方面对民办高校章程建设的现状进行分析,最终提出完善民办高校章程建设的三点思考:坚持法治原则,提高民办高校章程的规范性;坚持程序正义原则,提高民办高校章程的科学性;坚持改革原则,提高民办高校章程的有效性。
＂The Twelfth Five-Year Plan for the National Educational Development＂ points out that the emphasis of the next 5 years will be on constructing the charters of non-governmental schools and the board of directors. The new development situation for non-governmental institutions of higher learning requires improving their charters and strengthening institution construction. Based on the review of the past 30 years＇ process of charter construction in non-governmental institutions of higher learning this paper summarizes the basic characteristics of the process. Taking the charters of fifteen non-governmental institutions of higher learning in Beijing as examples, the current situations of charter construction are analyzed from the perspective of charter contents and the two aspects of development and approval. Finally it proposes three thoughts to improve the charter construction ： adhering to the principle of the rule of law to improve the normative of the charter; adhering to the principles of procedural justice to improve the scientific nature of the charter; and adhering to the principles of reform to improve the effectiveness of the charter.
