摘要
"转型期法治"是一种法治化的过程,是体现历时性、阶段性和转折性的概念。对其进行研究,既需要考察影响它的国情性因素,也需要从法治本身的内部因素来描述。转型期法治的国情性因素包括时间、空间、环境与主体四个要素。转型期法治从观念形态、过渡策略、发展进路、运行环节四个方面来回应国情性因素,构成回应性因素。转型期法治要完成蜕变走向成熟,需要优化和强化若干中国式的任务,包括:缩减"半法治"的范围,有区分地应用建构与演进两种进路,把握转型时机与重点,选择并健全法治的必备制度要件,消解实质性思维的副作用以树立法治观和正义观。
＂Transitional Rule of Law＂ is a process of legalization. It is a concept that embodies historicity, momentary and transforming. We need investigate its external national conditions and its inherent elements in order to study it. The national conditions include four elements ：time,space,enviorment and subject. Transitional Rule of Law corresponds national conditions through forms of ideas,strategies of transition, approaches of development and links of operation. All these four elements constitute responsive elements. We need to consolidate some Chinese Assignments so as to make transitional becoming normal. These Assignments include ：Reducing the scope of partly rule of law;Using methods of construction and evolution separately; Grasping moments and focal points;Choosing sound institutional conditions;Wiping off negative effects of substantive thinking in order to set up notions of rule of law and justice.
