摘要
本文以"奇虎360诉腾讯案"为切入点,论述了互联网行业具有创新迅速、传播速度快、市场双边性、产品低费用甚至免费等特征。这导致了传统反垄断中对相关市场的界定方法用于互联网相关市场界定时存在很多缺陷以致无法适用,而我国互联网反垄断实务也面临一些困境,对此提出了解决方法,即从互联网相关市场包括互联网相关产品市场、互联网相关地域市场、互联网相关时间市场三个维度加以考虑,只有在结合互联网市场特性及互联网产品特性的基础上,才能准确界定互联网相关市场,进而指导我国的互联网反垄断实务,以期保持互联网市场竞争公平、自由、有序地进行。
The Internet industry is characteristic of fast innovation and spread, bilateral market, and low-cost and even free products. Such features make the definition of the relevant markets in traditional antitrust inapplicable to the Interact antitrust. On the other hand, the practice of China's Intemet antitrust also faces difficulties. Based on the case of"Qihoo 360 litigation against Tencent", the author suggests that Interact-related markets should include product market, geographic market and time market, and by combining the features of the Interact-related market and its products, we can accurately define the Intemet- related markets so as to guide China's Intemet antitrust practice and to ensure a fair, free and orderly market competition.
