摘要
在当今的全球化时代,表征现代文明的法治与人权,已跨越国界获得普遍化地发展,且随着发展观的演进,人权成为现代法治的根本指向。基于对现代体育发展走向及其与社会进程关系的整体关切,采用文献资料研究、历史与比较分析等方法,根据全球化背景下人权事业发展的法治化趋势,对现代体育随动于社会进步的人本走向和体育人权日益凸显的历史进程进行考察,通过国际社会为体育人权构建法治保障和中国体育在人权法治加强中走向世界的阐析,揭示体育人权与体育法治的价值意义,以探寻和提升对体育发展规律的理性自觉。
Rule of law and human rights, which represent modem civilization, been widely developed across nation al boundaries and become signpost of modem role of law in present age of globalization. Based on the overall con cem about the modem sport development trend and its relationship with the social process, this paper surveyed hu manism tendency and sports human fights in modem sport by the methods of literature review and historical com parative analysis. Under the background tendency which human rights becoming basic orientation of the modem rule of law, this paper revealed value of sports human rights to rule of sport law, by the way of analysis the guaran tee of law for sports human rights in international society and tendency of strengthen role of human rights in China sport, which is to explore and enhance selfconsciousness development of sport.
