摘要
异议股东股份回购请求权是股东平等原则的重要体现。我国新公司法顺应国际立法潮流规定了这一制度,对其适用范围做了明确规定,但是对于该权利的具体行使程序,则规定得过于简略,这给法律权利转化为实际权利增加了难度。
Dissent shareholders stock repurchase request right belongs to an important embodiment of the principle of shareholders＇ equality. Our country＇s new company law, complying with the international legislation trend, sets specific provisions for the applicable scope, but to the specific exercise program of the right, the rules are too simple, which increases difficulties in converting the legal rights into the actual rights.
