摘要
在知识的淘金热中,业界多有采用合作研发新技术模式者。我国专利法未明确规定专利共有的性质,由此引发了相关的权属纷争。专利权实为专利财产权,除当事人另有约定外,原则上应为按份共有。共有专利权与共有人对专利权所享有的份额是两个不同的概念,在共享专利的语境中,共有人对共有专利权能的实施不受其所享有份额的影响。此外,企业合作研发共享专利者还可能与专利法上的职务发明相抵触,由于专利法缺乏相关规定,如有纠纷,只能以激励创新的立法宗旨为导向,综合考虑、个案解决。
Knowledge of the gold rush in the industry have adopted more collaborative R ＆ D of new technologies patterning. Total patents and patent owner of the share enjoyed by the two different concepts, the patent in the context of sharing, co - owner of the patent to the implementation of total enjoyment from their share of influence. In addition, R ＆ D Cooperation could also share the patent on the patent law and contravene the invention, due to the lack of the relevant provisions of the Patent Law, where disputes can only be the leg- islative intent of encouraging innovation - oriented, comprehensive consideration of the case resolved.
