摘要
隐私权是权利主体必不可少的排他性权利,也是人身权中的一项重要权利。在现代信息社会里,人们在享受网络所带来的便捷的同时,隐私权也正在面临极大的挑战。我国应当结合国情以及国外先进立法经验,通过确认隐私权的新类型、实行实名制、谋求国际一体化解决等方式,使隐私权在网络时代背景下能够得到切实的保障。
The right of privacy is an exclusive right,which is not only essential to the subjects of right but also an important personal right.In the modern information society,the Internet to everyone is food and clothing.However,when we are enjoying the convenience brought about by the network,many of our legitimate rights and interests are also facing great challenges.And the right of privacy in the network exudes especially vulnerability.the allthor will combine the actual state of affairs in China as well as advanced legislation abroad to explore the protection of privacy in the background of Internet.The author believes that a clear right of privacy through new types of protection,real-name system,seeking to resolve international integration,etc.,will ensure that personal rights and interests can be effectively protected in networked society.
