摘要
我国农村土地集体所有的主体"集体",其涵义随着时代的变化而发展。面对现今的市场经济,集体所有作为成员个人享有民事权利的特殊形式,集体兼具所有者和成员利益维护者的双重身份。现实中,集体所有权的权能则需通过集体意思自治的表达机制实现;村委会与集体经济组织互补与完善共建形成的机制对现今意义的集体角色的扮演至关重要。
The meaning of collective organization,the subject of rural collective land ownership,is deve-loping along with the time.At present,the collective ownership is the specific form for the members＇ individual civil rights under the condition of marketing economy,and collective organizations play both the roles of owner and the maintainer of their members＇ rights.In reality,the capability of collective ownership should necessarily be expressed by the means of autonomy of collective organizations.Nowadays,the mechanism depending on the inter-supplement between village neighborhood committees and collective economic organizations is vital to the role-playing of the collective organizations.
