摘要
新修订通过的《科技进步法》和《专利法》(修订草案送审稿)都增加了对国家财政资助科研项目完成发明创造知识产权归属等问题的规定。为了加深对该规定的理解,本文探讨了主要利用国家财政资助科研项目完成发明创造的专利权归属、发明创造归属于项目承担单位时国家应保留的权利、项目承担单位的权利和义务、发明人或者设计人的权利和参与项目第三方的权利等问题。
The content of patent ownership of inventions -creations arising from government- funded research has been added in The Law of Science and Technology Progress （the amendment bill）and Patent Law（the amendment bill to be approved）. In order to deepen the understanding of the provisions, this paper analyses as follows, the ownership of patent right of inventions - creations arising from mainly government -funded research, the rights retained by state without patent ownership, the rights and obligations of contractors, the rights of inventors or designers and the rights of third parties participating in the project.
