The 5th Session of the 10th National People’s Congress approved the Property Law, which will take effective as of Oct. 1, 2007. As the basic civil law that regulates the property relationships, issuance of the Property Law is undoubtedly an important matter in social and economical life of China. The Property Law has special meaning for regulating the ownership of properties, stabilizing social and economical order, making best use of property and protecting rights of the obligees. The property as specified in the Property Law refers to the dominating and exclusive rights enjoyed by obligees on specific articles. The vessel property, which takes vessels as the target, is under the jurisdiction of the Property Law. The Property Law not only regulates the vessel property (such as Article 24 about changing mode of vessel properties, Article 180 and Article 188 about mortgage property about vessels and vessels in construction), but also includes general principles and system that are suitable to vessel property. Therefore, the implementation of the Property Law will have certain influences on vessel property and existing laws and regulations on vessels.
