摘要
我国体育法学的研究已经取得了可喜的成就 ,但体育法学要提升理论层次 ,向学理化方面发展。体育法学学理化应有 4条标准 ,在学理化思维过程中 ,应特别关注对体育“实在法”的合法性基础的反思 ,建立、提升体育法学的理论层次 ,要有超越性理念 ,才能实现理性的超越。
The research of sports law has already obtained pleasing achievement, but sports law should promote the theories level, and develop towards theories. The theories of sports law should have four standards. In the process of studying, special attention should be legality of sports, establish and promote theories level of sports law, and overstep the principle. Only by this can overstepping of reasonableness be realized.
