摘要
公众参与环评作为多边开发银行开展国际项目融资的先决条件,不仅有助于增进公众对项目的认同,而且能有效地消弭或减缓项目潜在的环境和社会风险,是多边开发银行践行可持续发展、绿色金融和环境正义运营原则的应有之义。作为第一家由我国倡导建立的多边开发银行,亚投行虽在成立伊始就严格要求自我,将"绿色"奉为其三大运营理念之一,且其晚近出台的《环境与社会框架》亦对公众参与项目环境影响评价作出了相应的规定,但这些规定仍存在着主体范围模糊,信息披露不健全,公众参与范围、方式、程序不完整和申诉机制不周延等缺陷。无论是基于自身贷款对象的特殊性和提升私人资本开发性投资战略定位之考量,还是适应日常联合融资抑或单独融资业务扩容之所需,新生的亚投行都有必要完善和细化现有的公众参与环评规定,从而更好地发挥引领和确保亚投行绿色投资之功效。
Public participation in the EIA(environmental impact assessment)as an premise of multilateral development banks’international project financing not only helps increase the public’s recognition of the project,but also effectively eliminates or mitigates potential environmental and social risks of the project.This is what multilateral development banks should do for the principles of sustainable development,green finance,and environmental justice.As the first multilateral development bank initiated by China,the AIIB has strict self-requirements since its inception,and regards“green”as one of its three major operational concepts.Although the“Environmental and Social Framework”recently issued by the AIIB has made relevant provisions for public participation in the EIS of the project,there are still problems such as ambiguous subject scope,unsound information disclosure,imperfection of the scope of public participation,and lack of grievance mechanism for public participation.Whether it is from the consideration of the particularity of its own investment target,or its daily co-financing or individual financing business expansion,it is necessary for the new AIIB to improve and refine the existing public participation in the EIA regulations in order to better guide and ensure the effectiveness of its green investment.
