摘要
党政责任制立规是指具有规范制定权限的党政主体,为表达党政共同意志,在特定国家治理领域内制定普遍性、明确性的行为规则,就重要国家事项进行党政职责划分、履责督导、责任追究,从而构建专项党政责任制度的规范制定活动,具备政治性、综合性、灵活性特点。作为贯彻落实党的全面领导的重要法治方式,党政责任制立规主要通过职责分解、履责督导和责任追究三大环节发挥其作用功能。由此,党政二元立规主体实现了党政组织的有效配套、党政权力的紧密衔接和党政责任的合理划分。“第一责任人”制度等五项重点特色下位制度的确立则进一步提升了具体领域的立规效能、增强了立规刚性,有益于立规作用的充分发挥。
Party and government responsibility system to establish regulations refers to the party and government subjects with norm-making authority,in order to express the common will of the party and government,to develop universal and clear rules of conduct in a specific area of state governance,to carry out the division of party and government responsibilities,performance supervision and accountability on important state matters,so as to build a special party and government responsibility system of norm-making activities.It has the characteristics of politics,comprehensiveness,and flexibility etc.As an important method of rule of law for the implementation of the party’s overall leadership,the establishment of the party and government responsibility system mainly plays its role and functions through three major links:Responsibility decomposition,responsibility performance supervision,and accountability.As a result,the main body of the party-government dualistic regulation has realized the effective matching of the party-government organization,the close connection of the party power and the reasonable division of partygovernment responsibilities.The establishment of the five key characteristics of the"first responsible person"system and other lower-level systems have further improved the efficiency of the establishment of specific areas of regulation and strengthened the rigidity of the regulations,which is conducive to the full play of the role of the regulations.
