摘要
知识产权侵权责任承担方式具有自身的“特殊法理”。知识产权客体的无形性和公共产品属性孕育了知识产权侵权责任承担方式的“特殊法理”。“知识产权请求权”责任承担方式中的“特殊法理”体现为“知识产权的效力扩张至侵权物品”“停止侵害的责任承担方式不能当然适用”;“侵权损害赔偿”责任承担方式中的“特殊法理”体现为“确定知识产权权利人的利益范围是承担侵权损害赔偿责任的前提”“知识产权侵权损害赔偿数额的确定是通过司法自由裁量权统合多种主客观因素实现的”。《民法典》对知识产权侵权责任承担方式“特殊法理”的回应存在“空隙”,“特殊法理”应当在知识产权法领域实现规则转化,具体转化方式包括“限制”方式、“转换”方式、“延伸”方式和“单一”方式。
The mode of intellectual property infringement liability has its own“Special Fali”.The intangibility of the object of intellectual property and the attribute of public goods give birth to the“Special Fali”of the mode of intellectual property infringement liability.The“Special Fali”in the mode of“claim of intellectual property”is embodied in“the effectiveness of intellectual property extends to the infringed goods”and“the mode of stopping infringement cannot be applied absolutely”.The“Special Fali”in the“infringement damage compensation”is embodied in“determining the scope of interests of intellectual property rights holders is the premise of assuming damages”,“the amount of damages in tort of intellectual property is realized by integrating various subjective and objective factors through judicial discretion”.There are“gaps”in the response of Civil Code to the“Special Fali”of intellectual property infringement liability.“Special Fali”should be transformed into rules in the field of intellectual property law.The specific transformation methods include“restriction”,“transformation”,“extension”and“singleness”.
