摘要
公平正义是司法的灵魂和生命,也是刑事指控追求的价值目标。中国特色刑事指控基本定位是坚持中国特色社会主义法治道路,秉持客观公正立场,既做犯罪的追诉者、无辜的保护者,又做正义的捍卫者。一方面,应积极回应当下以审判为中心的刑事诉讼制度改革要求,推动协商指控的本土化改造,实现刑事指控与诉讼监督、刑事追诉与客观公正的有机统一;另一方面,在刑事指控要素的配置上应实现体系化,把刑事证据及相应的指控证据规则作为刑事指控的核心,把诉讼主体间的控侦、控监、控辩、控审"四大关系"作为刑事指控的重点,同时把刑事指控中的指导性案例、司法解释、司法政策作为保障,构建起侦查基础、审前主导、庭审主责、诉讼监督、司法引领"五位一体"的以证据为核心、以检察为主导的刑事指控体系。
Fairness and justice are the soul and life of the judiciary,as well as the valuable goal persued by criminal accusation.Criminal accusation system with Chinese characteristics is based on as follows:Insist on the socialist legal system with Chinese characteristics,uphold objectivity and fairness and be not only the prosecutor of criminals and the protector of the innocent,but also be the defender of justice.In this basis,on the one hand,it responds to the current reform requirements of the criminal procedure system centering on trial,completes the local transformation of the negotiation charge so as to keep criminal accusation and litigation supervision,criminal prosecution and justice in line,on the other hand,it implements systematization in terms of criminal accusation elements disposition.That is to take the criminal evidence and corresponging charge evidence rules as the core of criminal accusation,focus on the four relationships,take judicial interpretation and judicial policy as assurance and guidance,build a five-in-one criminal accusation system which takes evidence as the core and makes prosecution as the leading role.
