摘要
平台经济作为一种新的经济模式,具有与传统经济模式明显不同的特点,套用传统的反垄断监管政策可能会带来监管失误,进而阻碍平台经济的创新发展。科学监管必须基于对平台经济属性的准确把握和科学界定,进而采取有针对性的监管政策设计。数字平台本质上是一个交易中介,其对通过平台进行的交易主要承担间接责任,但"守门人"地位平台的出现客观要求强化平台的规制义务。平台具有数据信息节点、交易中介、生态规制者三重角色,平台运营涉及消费者、合作商家、竞争平台、社会四重利益关系。为实现数字平台有效监管,应重点强化事前行为规则监管,确立规则透明、交易公平、安全信任、客观中立、开放接入的基本行为规则,并建立系统、协同、高效的反垄断监管体系。
As a new economic model,the platform economy has characteristics that are significantly different from the traditional economic model.The application of traditional anti-monopoly regulatory policies may cause regulatory errors and hinder the innovative development of the platform economy.Scientific regulation must be based on an accurate grasp and scientific definition of the economic attributes of the platform,and then a targeted regulatory policy design can be adopted.The digital platform is essentially a transaction intermediary,which mainly assumes indirect responsibility for transactions conducted through the platform,but the emergence of the"gatekeeper"platform objectively requires the strengthening of the platform’s regulatory obligations.The platform has the triple roles of data information nodes,transaction intermediaries,and ecological regulators.The operation of the platform involves the four-fold interest relationship of consumers,cooperative merchants,competitive platforms,and society.In order to achieve effective regulation of digital platforms,it is necessary to focus on strengthening the regulation of prior behavior rules,establish basic behavior rules of transparent rules,fair transactions,security trust,objective neutrality,and open access,and establish a systematic,coordinated,and efficient antimonopoly regulation system.
