高校职务科技成果的权利配置规则研究 被引量:33

On the allocation rules of employee’s invention in Chinese universities

摘要 我国高校科技成果的权利配置表现为一种单位主义的模式,但在实践中的运作效果不理想,科技成果的转化效率较低。其原因在于只是从初始分配上来界定科技成果的所有权,而未能对科技成果的社会利用进行有效的制度激励,混合所有制改革虽然在权利配置上产生较大的激励效果,但也面临正当性的难题。科技成果的权利配置涉及多重利益关系和制度目标,因此,不存在一个价值最大化的分配方案,在设计科技成果的权利配置规则时要充分考虑知识产权转化机制和市场机制,尊重当事人之间的权利选择,以多种方式实现权利的优化配置。 The allocation of rights of employee’s invention in Chinese universities exhibits apparently characteristics of DanWei model, but its actual effects in practice is not very well, and the ratio of technology transfer has always been very low. The reason lies in that the ownership of employee’s invention is defined only from the initial allocation, not from the practical effects to incentivise its social utilization. While the reform of mixed ownership seems to produce,to some extent,incentive effects because of its innovative allocation of rights, it also faces the problem of legitimacy. Since the allocation of employee’s invention involves multiple interests and different purpose of different institutions, therefore, there does not exist a single one model of value maximization on the allocation issue. So in the making of the specific rules, we should take seriously the mechanism of intellectual property rights,and the parties’ right to choose, as a result to achieve the optimal allocation of rights by way of various choice.
