摘要
本文对于"商标戏仿"的概念进行了界定并从商标戏仿的本质出发,综合应用多种分析方法,讨论了"合理避让义务""商标性使用"等判定指标的优劣、确定方法以及适用顺序,得出了以下基本结论:(1)商标戏仿不侵权的前提是不造成关联关系混淆。(2)在判定是否构成商标淡化时,将商标戏仿分为"玩笑戏仿""联想戏仿""恶意戏仿"三种类型。针对不同类型进行福利经济学分析,进行侵权判定。
This paper defines the concept of"trademark parody".Based on the essence of trademark parody,this paper comprehensively applies various analysis methods and discusses the advantages and disadvantages of certain indicators such as"reasonable avoidance obligation"and"use as a trademark".The result of applying these methods have led to the following basic conclusions:(1)The premise is that it does not cause confusion of connection.(2)When deciding whether to constitute a dilution infringement,trademark parody is divided into three types:"joke parody","association parody"and"malicious parody".According to welfare economic analysis of different types,give suggestions on infringement determination of trademark parody.
