摘要
近年来,我国涉及数字资产的犯罪活动呈现上升态势,给公安机关侦查工作带来新的挑战。数字资产价值波动性大,公安机关在法院判决前先行予以处置,具有正当性和必要性,符合我国立法规定和国际司法惯例。目前,公安机关面临数字资产扣押难、保管难、保值难的技术障碍,启动权与执行权合并模式异化出处置机关权力行使过慎和过滥的错误倾向,受托第三方公司的处置也存在违规隐患。因此,有必要构建“集中统一平台+第三方”的处置模式,由检察机关负责启动先行处置,公安机关负责后续的具体执行。在数字资产先行处置过程中,要切实保障诉讼参与人知情权、异议权、救济权等权利,真正实现程序的规范公正和公开透明。
In recent years,crimes involving digital assets have been on the rise in our country,bringing new challenges to the investigation of public security organs.The value of digital assets is highly volatile,and it is legitimate and necessary for the public security organs to handle them before the judgment,which is in line with China's legislative provisions and international judicial practices.At present,the public security organs are facing the technical obstacles of"difficult seizure,difficult storage,and difficult preservation"of digital assets,the"combination of start-up and execution rights"has alienated the wrong tendency of excessive caution and power abuse,and the entrusted third-party disposal companies also have hidden dangers of violations.Therefore,it is necessary to build a"centralized unified platform and third party"disposal model,in which the procuratorial organ is responsible for starting the first disposal,and the public security organ is responsible for the subsequent specific implementation.In the process of the first disposal of digital assets,it is necessary to effectively protect the rights of litigation participants to know,object,and remedy,and truly realize the standardized,fair,open and transparent procedures.
