摘要
抗击新冠肺炎疫情背景下我国应急法制体系正在修订重塑,应急预案作为法律制定的重要依据也应趁机优化。整体性治理理论在政府治理方面为不少国家所倚重,其多面向、全流程、多主体的整合举措对我国应急治理及预案体系的优化提供了思路和指导。整体性治理理论和我国现实相结合推演出"五维整合"框架,基于"五维整合"框架设计的国家应急预案体系以"一梁四柱三级"为架构,能够落实以社区为中心、政府主导、多元主体参与等理念,依托"应急管理平台"整合各类系统,辅助预案体系落地,并从制度层面实现平战结合、关口前移。
Under the current COVID-19,Chinese emergency management legal system is undergoing important reforms.This opens up a particularly valuable window for a reinvigoration of the national response plan.The theory of holistic governance has been the paradigm for many governments abroad,and it has the potential to provide meaningful insights for us.Based on this school of thought and our particular situation in China,I propose a novel framework for a new national response plan.It is argued that this improved version can assist in an efficient reorganization of various relevant and pre-existing institutions,facilitate community engagement and that from the wider society,and thus minimize social costs of potential contingencies.
